Q. Does an annulment of the Irish civil contract of marriage affect the Islamic status of a marriage?

A. I have just received a response from Shaykh Dr Muhammad Bazmool (Makkah) about the annulment question.

First, the Shaykh emphasised the importance of leaving the lands of kufr when one is not able to practice one's religion due to the restrictions and laws. The scholars often remind us of this, keeping in mind that this hijrah is dependant on one's ability to leave and find residence in the Muslim lands.
Second, on the issue of the marriage itself. The Shaykh confirmed that if your husband is able to annul the marriage with the Irish authorities, because of some condition not being met or the likes, and as long as in doing so his intention is not actual divorce in Islam, then this is a way out for you both, and the marriage can be annulled with the Irish authorities and your real marriage contract is still valid.
